Position of Children of Free Marriage

The children of a free marriage were members of the father's household and under his paternal power. They belonged to his agnatic family. The mother and her children were not of the same family and no legal rights or duties existed on either side. But in later times by the senatus considta Tertullianiim (A. D. 158) and Orphitianum (A. D. 178) the right of succession of mothers to their children and of children to their mothers, respectively, was created.
