Definition of Marriage

According to Modestinus, "Marriage is a union of a male and a female, an association throughout life, a union of all their rights, both divine and human." (Dig. 23, 2, 1.)

According to the Institutes, "Marriage or matrimony is the union of a man and a woman, involving the habitual intercourse of daily life." (Inst. I, 9, 1), and "Roman citizens are joined together in lawful wedlock when they are united according to law." (Inst. I, 10, pr.)
